To the Probate Court of Salt Lake County, Utah,
The petition of Sabina Frieda Rufenacht (who is genearlly [sic] known as "Winnie" Rufenacht), respectfully shows:
1. That Rosina Rufenacht, also known as Rosie Rufenacht, died at Salt Lake City, Utah, June 16, 1968; that at the time of her death she was a resident of Salt Lake County, Utah, and owned property therein, consisting of improved and unimproved real property, as follow:
A home at 1158 South 8th East Street, Salt Lake City, Utah, of the
approximate value of $12,000.00, and having a rental value of, to wit,
$100.00 per month; also,
Unimproved real property, described as: commencing at the northeast
corner of Lot 12, Block 2, Capital Avenue Addition, running thence West
75 feet, South 117 feet, East 75 feet, North 117 feet to beginning; situate
corner of Kensington and Roberta Avenues; of the approximate value of
$7,000.00.
2. That decedent left a Last Will and Testament, which petitioner alleges to be the last will and testament of said decedent, and which is herewith presented.
3. The names, addresses and relationship to decedent, of all of her heirs at law and next of kin, and devisees and legatees mentioned in said will, are as follows:
Werner Rufenacht, son, 3122 Lincoln Street, Salt Lake City, Utah;
Mary M. Rufenacht, daughter, 1158 South 8th East, Salt Lake City, Utah;
Walter Rufenacht, son, 3627 Boyer Circle, Lafayette, California;
Robert D. Rufenacht, son, 1158 South 8th East, Salt Lake city, Utah;
Sabina Frieda Rufenacht, daughter, 1158 South 8th East, Salt Lake City,
Utah;
all over the age of 21 years.
4. That the witnesses to said will are Paul E. Reimann and Maybeth Farr Reimann, both of whom reside at 1586 South 2200 East, Salt Lake City, Utah; that at the time of the execution thereof, the said testator was over the age of 21 years, being of the age of 63 years or thereabouts, and was of sound and disposing mind, and not acting under duress, menace, fraud or undue influence, and was in every respect competent, by last will to dispose of all of her estate.
5. That said Will is in writing and signed by said decedent and attested to by said subscribing witnesses, at the request of said testator subscriging their names to said will in the presence of said decedent and in the presence of each other, and that said witnesses at the time of attesting the execution thereof, were competent.
6. That Sabina Frieda Rufenacht, residing at 1158 South 8th East, Salt Lake City, Utah, is named in said will as executrix; that she is competent to act, and consents so to do; and that according to said will she is to serve without bond.
Wherefore, you petitioner prays that the said will may be admitted to probate and that letters testamentary be issued to your petitioner, and for that purpose a time be appointed for proving said will, that all persons be duly notified to appear at the time for proving the same, and that all necessary orders may be made in the premises.
