Last Will and Testament of Edward E. Nelson
Know All Men By These Presents: That I, Edward E. Nelson, a resident of Minidoka County, State of Idaho, being of sound, disposing mind and memory and without restraint or undue influence, do make and declare this to be my last will and testament, hereby revoking all other wills by me made.
First: I do declare that all of the estate whereof I may die seized or possessed, that is all of the said real property, is my separate and individual estate.
Second: I do hereby declare that so soon after my death as convenient to my executor, hereinafter named, that my said executor shall pay all of my just debts, funeral expenses and expenses incurred in my last illness.
Third: I do hereby devise and bequeath unto my beloved wife, Mary A. Nelson, for so long as my said beloved wife, Mary A. Nelson, shall remain my surviving widow, all the rents and profits of my separate estate during her natural lifetime, provided, however, that from said rents and profits from my separate estate there shall first be paid all necessary taxes, assessments, maintenance, and necessary charges to maintain my estate free of all liens and encumbrances for taxes of other indebtedness.
Fourth: Whereas during my natural lifetime I have by deed and conveyance provided for my son, Robert E. Nelson, to my said beloved son, Robert E. Nelson, I do devise and bequeath the sum of one dollar ($1.00).
Fifth: To my beloved daughters, Doris Ann Nelson and Eva May Nelson, I do hereby devise and bequeath all the rest and residue of my estate, of whatsoever kind, nature and description, of which I may die seized, subject only to the life estate heretofore vested in my beloved wife, Mary A. Nelson.
Sixth: I hereby direct my executor hereinafter named after first paying all costs and obligations as provided by law to surrender and pay unto my beloved wife, Mary A. Nelson, my surviving widow, all the rents and profits thereafter remaining and to be by her held for her own use and benefit.
Seventh: I do hereby nominate and appoint H.V. Creason of Rupert, Idaho, to act as executor of this, my Last Will and Testament.
In witness whereof, I, Edward E. Nelson, Testator above named, have to this, my Last Will and Testament, hereunto subscribed my name and my seal this Seventeenth day of March, 1949.

The foregoing instrument was here and now, on the date hereof, sealed, published and declared by Edward E. Nelson, the above name testator, as and for his Last Will and Testament, in the presence of us how, at his request and in his presence and in the presence of each other, have hereunto signed their names as subscribing witnesses.
